Walmart Appeal Denied by Ellisville City Council

The citizens appeal for the Walmart project's conditional use permit was formally denied by the council Wednesday.

Ellisville City Council members voted to deny a citizens appeal against a Walmart conditional use permit at the council meeting Oct. 3.

Present members voted in favor of the denial 5 to 1, with Councilmember Michelle Murray absent and Mayor Adam Paul voting nay.

Paul said the council's "answers are inadequate for denial."

The appeal's consideration was initially on the agenda prior to public comments, but Councilmember Matt Pirrello moved to postpone call for roll on the issue until after the first set of public comments.

Tom DeBold, who owns property adjacent to the would-be Walmart and submitted the appeal, said there were things "I just don't understand" in the council's response.

DeBold said the residential property backing up to the project area is separated by a 4-foot fence, arguing a point in the appeal to comply with city code, that a neighborhood would not be adversely impacted by the project.

"If the general consensus is since it's a (conditional use permit), it doesn't affect property on my side of the fence, I don't have to agree," DeBold said during public comments.

"I thought a neighborhood was an area," DeBold said. "I didn't know it meant separation by a fence."

Pirrello went back to the city's comprehensive plan and Great Streets initiative master plan, saying both plans "contemplate a 'big box' on that site."

Pirrello added that the Great Streets plan is intended to be a supplement to the comprehensive plan, "merely guidelines for the city moving forward" and is revisited on a 5-year cycle.

"I hope you all can appreciate that some things listed in the appeal can't be substantiated," Pirrello said. "They're only conjecture or prediction."

The faster Pirrello is out of government, the better off we all are. It's going to a long couple of years waiting this windbag out.

It looks like the anti Walmart crowd just spent their last bullet.

There wasn't much of a chance was there?
By the way, how's the health: You going to make it to see your backyard Walmart in 2014, old fella?

There are many more steps in the process...I know some people, despite their self-professed high IQs, don't get it. That's fine. They are inconsequential.

E and Caffeinated sitting in a tree, k-i-s-s-i-n-g...First came love, then came marriage, and out popped a Walmart.

Oh, mike. You fool no one, you geriatric moron.

don't cry for me Caffeinated. I am retired, in good health and living the life of a millionaire since I am one. Also both my sons are in the top 1% earners in the U.S.
So you don't have to look it up, that means they have a adjusted gross income of $343,927 or more on an annual basis. As far as Mr. Pirrello goes, when his term is up if he decides to run again, I think I will write him a $10,000 check for his campaign just for the hell of it.

I wasn't crying for you, I was laughing at you.

I haven't talked to one area resident who thinks there is a need for another Walmart in the area....not one !
James S. Copeland, DC October 5, 2012 at 11:59 am
All this Walmart will do is put other area businesses out of business !

Homeless doesn't count Jimy
Caffeinated October 5, 2012 at 04:14 pm
Are you referring to Councilmember Matt Pirrello, who doesn't even own a home in Ellisville?
James S. Copeland, DC October 5, 2012 at 06:22 pm
Mike K: Not sure I understand your comment on homeless doesn't count....What are you referring to.
mike k October 5, 2012 at 10:00 pm
sorry Jim, you seem like a decent guy unlike Caffeinated who is a complete jerk. I was trying to make a joke, but obviously failed, my apologies. I believe Walmart will turn out to be a tremendous asset to Ellisville as it will attract numerous new businesses to the site surrounding the new Walmart in much the same way as has occurred in Chesterfield Valley. We can disagree for now, but time will tell which one of us is right or wrong.

"...Caffeinated who is a complete jerk"
And you are a loveable old man whom everybody adores. I'm still laughing.

Has anyone heard any news regarding the Walmart progess and when construction will begin?
James S. Copeland, DC November 27, 2012 at 01:01 pm
I can't believe all the childish comments above. The point is: The local residents for the most part, do not want a WalMart in the area. There are three Walmarts in three different directions that we can get to within 10 minutes . Why do we want another one which will simply put other stores out of business in the area.
WalMart doesn't care who it hurts while building it's empire of stores all over the world. What is the interest of the few who want it here. What's in it for them?
James S. Copeland, DC November 27, 2012 at 01:03 pm
Yes, the store might attract other business, but it will cause others in the area to go out of business at the same time. Just look up and down Manchester Road and count the number of empty store fronts. Especially where the old Walmart moved out....count the number of empty spaces. This will happen in Ellisville without a doubt.

Susan, I'll check in to see if there are any more updates. Last I had heard, construction wouldn't begin until after the first of the year. Thanks!
Susan Hunter November 27, 2012 at 02:14 pm
Thanks Bryanna...I talked with a couple of tenants at Clarkchester and they haven't heard anything from Sansone and the owners haven't as well. I would think closing on the property from the owners would be the first step in the process.

I think Ellisville's Mayor Adam Paul HAS been reinstated UNLESS this is an appeal to a higher court.Read More The Ellisville council members Murray, Anglin, and Pieper, Acup, Perrillo and City Attorney Martin who pocketed $50K from Sansone to help get the deal done. On top of the $65K the City - us taxpayers - paid Attorney Martin to look after our interests. These members should be removed by petition vote by the people or the courts for conflict of interest. And if Ellisville Attorney Martin is reading this, you are there to PROTECT the City & Citizens of Ellisville ONLY, NOT give advice as how to ENTRAP Ellisville's duly elected mayor. You are NOT there to give legal advice to ANY COUNCIL MEMBER who is trying to entrap other elected officials. Ellisville needs a HOUSE SWEPT CLEAN of these council members Murray, Anglin, and Pieper, Acup, Perrillo and City Attorney Martin because of CONFLICTS OF INTERESTS AND accepting money from Sansone & Wal Mart agents.
